Terms of Service

This Terms of Service (TOS) is an agreement between you and Tarekcloud. Tarekcloud is committed to providing reliable services and ensures that all customers can use the services reasonably through the following terms.

1. Changes to TOS

Tarekcloud may modify these terms from time to time without prior notice.

2. Billing Terms

Refund Guarantee

All normal VPS services provided by Tarekcloud are eligible for a limited refund, and the refund will be credited to the account balance.

Refunds are only applicable to overseas VPS server plans, excluding services in China and various additional services.

Refunds are only applicable within 24 hours after account registration and only for the first service for new customers. Additional orders are not eligible for refunds.

Services suspended or terminated due to a violation of the TOS are not eligible for a refund.

Services that have used over 10GB of traffic or more allocated bandwidth are not eligible for a refund.

Upgraded services are not eligible for a refund. Customers are responsible for canceling all auto-payment settings.

Note: Special offers/promotions during flash sales or promotional events (such as Black Friday, holiday sales, etc.) are not eligible for refunds.

Billing Rules and Information

Tarekcloud will issue all service bills 14 days before the service expiration. Payments should be arranged in time. Accounts that are overdue by 2 days will incur a 10% late fee. Tarekcloud reserves the right to impose additional late fees on repeatedly overdue accounts. These fees are non-negotiable and will be automatically added to any overdue bill. After 1 day of overdue, all services related to that bill will be immediately suspended, and after 3 days of overdue, they will be terminated. Bills paid multiple times via PayPal or credit cards will only be added as account balance, and cannot be refunded via PayPal or credit card. For assistance, please contact help@tarekcloud.com.

Disputes and Chargebacks

The customer acknowledges that any disputes or chargeback attempts with PayPal or credit card issuers will result in the suspension or termination of all services. Chargebacks based on false reasons will be considered fraudulent and treated as such.

Cancellation Notice

Cancellation must be completed via the cancellation form provided in the customer area. Please follow these steps: Customer Area > Services > My Services > Click the service you want to cancel > Request Cancellation.

Note: A cancellation request does not automatically mean a refund. If you cancel the VPS but do not meet the refund conditions, the canceled/terminated VPS service can be recreated for a fee of $5. If the same account repeatedly cancels services due to not meeting refund conditions, the VPS will not be recreated.

Membership Program

We offer a 10% account credit reward for each VPS order you refer. You must have a valid account to become a member. You can expect the credits to be added to your account only after the recommended VPS service is activated for a month. The credits cannot be withdrawn to your personal account.

Note: Some specific promotional packages may not qualify for credit rewards. Please contact sales@tarekcloud.com in advance.

3. Prices

Price Changes

Tarekcloud reserves the right to change service prices at the start of the customer’s next billing cycle. Due to historical decreases in bandwidth and hardware prices, we do not expect prices to increase generally. However, certain events beyond our control, such as changes in software licenses, energy, space, labor costs, regulations, taxes, etc., may lead to unexpected price increases.

Currency and Exchange Rates

Currently, all services are priced in USD. Tarekcloud reserves the right to reprice all or part of the services in another currency after notifying affected customers.

Prices for New Orders Only

Due to our inventory management and efforts to clear excess stock or adjust sales according to inventory levels, our prices change regularly. Therefore, any prices, special offers, or quotes listed on our website are only applicable to new server orders and cannot be applied to existing orders.

Special Offers

Special promotional pricing may be offered regularly to specific existing or potential customers, based on circumstances, the customer’s financial situation, and business goals. These offers are valid only for specific customers and cannot be transferred to other customers or applied to new orders.

Additional Services

IP address change fees for all locations: $2 one-time fee. Additionally, we do not guarantee the accessibility of provided data center IPs in China (due to the Great Firewall), Netflix, Disney+, dating websites, or websites that may block data center IPs (e.g., etsy.com).

More Bandwidth

KVM VPS in the US/EU region is $3/TB per month. In China, it is $3/TB per month, with 9929 model traffic halved. 10Gbps ports are $4/TB per month.

Storage KVM

Additional storage for VPS: You can add up to 20TB of extra storage at $4 per TB per month.

Additional IP for KVM VPS

$2 per IP per month for the US region, $3 per IP per month for EU/APAC regions. Each VPS can add up to 5 IPs.

Account and Service Transfers

Tarekcloud prohibits reselling or transferring accounts to other customers. We do not support changing the account email for this purpose. If such behavior is detected, the account and all related VPS services will be permanently terminated.

Tarekcloud allows service transfers to other customers. Transfers can only occur after the promotional plans have been activated for at least 7 days on the owner’s account. Transfer requests must be initiated from the seller’s account and are irreversible. Please operate in the push area in the customer backend. There is a $1 fee per transfer, paid by the transferring party. For domestic products, the receiving party must be a verified account with a consumption or recharge record within the last month.

4. Support

As our overseas services are managed services (domestic services use our own data centers), Tarekcloud does not provide hardware support related to customer server functionality. Tarekcloud  only guarantees default software installation and is not responsible for software configuration. Tarekcloud is not responsible for any downtime caused by OS configuration errors. KVM/LXC VPS customers can reinstall their operating systems through the control panel. Tarekcloud does not provide any third-party customer support. We only provide support directly to Tarekcloud  customers.

5. Backup and Data Loss

The risk of using services is borne by the customer. Tarekcloud is not responsible for files and/or data on your account. You agree to take full responsibility for the files and data transmitted and maintain proper backups of all files and data stored on Tarekcloud servers.

6. Abuse Policy

Account Usage

Accounts, passwords, and other private information are for customer use only. The customer is responsible for any use of their service or account and should maintain the security of the account and password. Tarekcloud will only request user passwords through our security ticket system. You should not provide your username or password to anyone else at any other time. We do not allow multiple accounts on Tarekcloud.

Unacceptable uses include but are not limited to:

  • Cryptocurrency mining (e.g., Bitcoin/Ethereum mining, Chia plotting, etc.)

  • Child pornography

  • Any activities leading to DMCA copyright complaints

  • Malware/viruses/security exploit activities

  • Terrorist activities

  • Spam emails

  • Phishing

  • Port scanning, brute force, or any other hacking attempts

  • DDoS/DoS/booters/network flooding or similar cyber-attacks

  • Acting in any manner inconsistent with applicable laws

Communication

Abusive, obscene, rude, or insulting language is not tolerated and may result in immediate account termination without a refund.

Operating System

Our different VPS plans have varying host environments. Due to the specific resource requirements of Windows, generally, installing Windows via any method on VPS plans that do not explicitly offer Windows installation options is prohibited. Violating this rule may result in temporary or permanent suspension of service without a refund.

BitTorrent

Legal use of BitTorrent is allowed, including running trackers, clients, or websites with non-infringing content,If you are unsure about the copyright legality, do not attempt to engage in torrenting activities.

Frequent or unresolved DMCA complaints may lead to service suspension, and IP abuse will incur penalties.

Due to resource limitations, BitTorrent is only allowed on Windows VPS, KVM storage VPS, and dedicated servers.

Bandwidth Usage:

You will be allocated a monthly bandwidth quota, which varies based on the hosting plan you purchase. Unless otherwise specified, traffic is calculated bidirectionally, and the VPS’s network will be paused once the bandwidth is used up. Unused traffic in a month cannot be carried over to the next month.

Network ports are shared, so continuous high bandwidth usage is not allowed. This includes sustained usage of over 100mbps for 6 hours or frequently maxing out ports (1Gbps or 10Gbps).

CPU Usage

CPU cores on KVM VPS are shared among multiple VPSs. If your VPS continuously uses one or more cores and affects the performance of other customers on the same host node, we may ask you to reduce usage. Disruptive loads may lead to VPS reboot, shutdown, or suspension, regardless of the duration. A 30% average usage rate is acceptable. You may burst your usage to 100% for up to 1 hour within every 24-hour period.

Resource Usage

No user may(This applies only to VPS products without special instructions):

  • Use 100% or more of system resources for more than 1 hour(Applies to CPU, disk I/O, and bandwidth only).

  • Run any game servers like Counter-Strike, Half-Life, Battlefield 1942, etc. (except for game servers).

  • Run TOR.

Note: The above hardware resource limitations apply only to VPS products. For VDS products, please refer to the purchase page for details. VDS products come with a more flexible usage policy.

Violating any of these limits may result in account termination without prior notice, and we reserve the right to inspect the account content at any time.

7. China Mainland Region Product Description

Real-name Verification

Purchasing products in this region requires real-name authentication (integrated with Tencent Cloud’s verification interface, limited to one attempt per day; please follow the ID-upload instructions on the page). You may only purchase related products after completing verification on the KYC page in your personal user dashboard.

Notes

When using products in this region, you must comply with all applicable local laws and regulations. They are strictly prohibited for illegal or non-compliant purposes such as fraud, phishing, file hosting services, cryptocurrency mining, VoIP, etc. Deploying VPN services, DNS services, NTP services, email services, public proxy servers, or similar services is forbidden. Any such activities or services discovered will be immediately and permanently terminated. Furthermore, these regional products are intended for personal use only; public or widespread use is not permitted.

Network Description

For IPv4: HTTP/HTTPS services are prohibited; by default, access from outside Mainland China back into China is blocked; if bidirectional overseas blocking applies, it will be noted on the purchase page; UDP support and complimentary entry points in certain plans are subject to various factors and are not guaranteed.

For IPv6: HTTP/HTTPS services are prohibited;No other restrictions at this time.

We reserve the right to terminate any account at any time for violating the above restrictions and inspect any account’s content at any time.
